Terms of Service

Agreement to Terms

By engaging Data Point Marketing (“Company,” “we,” “us,” or “our”) for any services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Services

Data Point Marketing provides digital marketing services including paid media management (Google Ads, Meta Ads, TikTok Ads), search engine optimization, website design and development, and marketing analytics. Specific deliverables, timelines, and fees are outlined in individual service agreements or proposals.

Client Responsibilities

You agree to provide accurate information, timely feedback, and necessary access (ad accounts, analytics, website) required to perform services. Delays caused by failure to provide access or approvals may affect project timelines.

Payment Terms

Payment terms are established in your service agreement. Unless otherwise stated, invoices are due within 15 days of receipt. Late payments may result in service suspension. All fees are non-refundable unless explicitly stated otherwise.

Intellectual Property

Upon receipt of full payment, you own all final deliverables produced specifically for you. Data Point Marketing retains the right to use work samples in portfolios and case studies unless you request otherwise in writing.

Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement, including but not limited to business strategies, account data, and customer information.

Data and API Access

To deliver services, we may access third-party platforms on your behalf including Google Ads, Google Analytics, Meta Business Manager, and other marketing tools. You authorize this access by providing credentials or account access. We handle this data solely to perform the agreed services and do not sell or share it with third parties.

Limitation of Liability

Data Point Marketing is not liable for indirect, incidental, or consequential damages including lost profits or revenue. Our total liability for any claim related to services shall not exceed the amount paid for those services in the 30 days preceding the claim.

Termination

Either party may terminate services with 30 days written notice. You remain responsible for payment of services rendered up to the termination date.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in Lancaster County, Pennsylvania.

Changes to These Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
